Odometer Disclosure Information
Dealers are required to retain records containing an odometer declaration for five years. These records must be open for inspection by the Secretary of State, State Board of Registration of Used Motor Vehicle Dealers, or representatives of the Department of Revenue.
Sellers must accurately disclose vehicle’s odometer reading at the time of sale on a secure transfer document (Title, Dealer Reassignment, or Secure Power of Attorney).
Sellers should
Enter the following in the odometer box:
- Actual mileage, or
- The word “exempt” when the vehicle is exempt from odometer disclosure
Buyers should
- Acknowledge the odometer declaration made by the seller by printing name and signing a title with actual mileage listed
Odometer Disclosure
The following vehicles are exempt from the odometer disclosure requirements of the Federal Truth in Mileage Act:
- Vehicles with a gross vehicle weight rating of more than 16,000 pounds
- Vehicles that are not self-propelled (i.e., trailers)
- Vehicles that are 20 model years old or older
- Vehicles sold directly by a manufacturer to a U. S. government agency in compliance with a contract’s specifications, and
- New vehicles transferred from dealer to dealer prior to the first retail purchase
Odometer Discrepancy requires the following documents be submitted:
- Completed and signed Form T-107 Odometer Discrepancy Affidavit or Form T-107A Application Odometer Discrepancy Affidavit.
- If the discrepancy occurred with a previous owner, more than one affidavit may be required.
If the title has not been applied for yet, submit:
- Completed and signed Form T-107 Odometer Discrepancy Affidavit or Form T-107A Application Odometer Discrepancy Affidavit.
- Completed and signed MV-1 Title/Tag Application.
- Supporting documents.
- Applicable title fees.
If the title issued reflects an incorrect odometer reading as a result of a keying error and the Department’s title record supports the correct information, submit:
- Completed and signed Form MV-18A Affidavit of Correction.
- Issued valid title.
- No fees when Department’s records reflect the correct odometer reading.
If the title reflects incorrect odometer due to error only on the title application, submit:
- Completed and signed MV-1 Title/Tag Application.
- Completed and signed Form T-107A Application Odometer Discrepancy Affidavit.
- Issued valid title.
- $18 title fee.
